MakerState Camp & Programs Terms & Conditions 2024 

WAIVERS: 

In consideration for permitting my child(ren), wards, or relatives (hereinafter “Camper(s)”) to participate in STEM Summer Camp, holiday camp, school or community-based maker program, birthday party, special event, etc. (hereinafter “Camp”) hosted by MakerState and/or Student Union (hereinafter “MSSU”), I voluntarily agree, for myself, my heirs, executors, and administrators to the following: 

MEDICAL AUTHORIZATION AND WAIVER: 

I understand and agree that MSSU will notify me if Camper(s) is injured or appears to be ill or if there is another emergency so that I can make decisions about my child and/or arrange to have them picked up. In case of emergency and I cannot be reached, I authorize MSSU, its agents, and employees to contact and secure, if necessary, medical attention for my child. In connection with any injury Camper(s) may sustain or illness or other medical conditions Camper(s) may experience during his/her/their participation in or attendance at the Camp, I authorize any emergency first aid, medication, medical treatment, or surgery deemed necessary by the attending medical personnel if I am not able to act on Camper(s)’s behalf. In the event that I cannot be contacted in the event of an emergency, I further hereby grant MSSU permission to administer immediate treatment and/or take Camper(s) to a hospital emergency room via ambulance/emergency vehicle if necessary, or a walk-in urgent care facility. I agree to assume all liability for any expenses incurred in such an emergency (transportation, hospitalization, treatment, medication, x-rays, etc.). 

PHYSICAL SUITABILITY 

On behalf of Camper(s), I accept and assume any and all risks associated with their attendance and participation in the Camp and all related activities. I understand that Camper(s) should not attend the Camp if they are not in a healthy condition and able to do so. Permission is granted to MSSU to take Camper(s) to parks, playgrounds, and other locations outside Camp facilities for recess, projects, activities, and games. Furthermore, I do hereby verify that Camper(s), to the best of my knowledge, is free from contagious disease, including Covid, is fully immunized/vaccinated, and is able to participate in the Camp. Therefore, I hereby confirm that Camper(s): (1) has no psychiatric, medical, and/or physical condition or history which would prevent them from participating in the Camp and/or endanger themselves or others at the Camp; (2) has not been instructed by any physician to refrain from participating in the Camp or similar activity; and (3) is physically fit and able to participate in the Camp. 

ASSUMPTION OF RISK/WAIVER OF LIABILITY 

Participation in the Camp involves a risk of injury due to certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries, examples of which are as follows (but not limited to these examples): contact with other individuals in or out of the camp space, contact with other individuals playing games, contact with the floor/ground, walls, chairs, desks, materials, or equipment which are part of the classroom, recess, and lunch areas. The specific risks vary from (1) minor injuries such as scratches, bruises and sprains, to (2) major injuries such as broken bones, eye injury, joint or back injuries, heart attacks, and concussions, to (3) catastrophic injuries including paralysis and death. I understand that if I have questions about possible hazards, it is my responsibility to seek additional information from the Camp management prior to signing this waiver. I agree to assume these risks. 

I, on behalf of Camper(s), assume all of the foregoing risks, including, but not limited to, the risk of any negligence by other Camp participants or by MSSU, and its respective owners, partners, directors, officers, employees, and agents, and the risk of injury caused by the condition of any 

real or personal property, facilities, or equipment used during the Camp, and accept personal responsibility for any injury (including, but not limited to, personal injury, disability, dismemberment, and death), illness, damage, loss, claim, liability, or expense (including reasonable attorneys’ and professionals’ fees), of any kind or nature, that Camper(s) or I may suffer arising out of or in any way connected with the Camp or Camper(s)’s participation in or attendance at the Camp. I understand that these risks may result from the actions, negligence, and failure to act of Camper(s) and others (including, but not limited to, other participants in Camp, and the organizers, employees, staff, counselors, and volunteers, if any, of the Camp) and the condition of any real or personal property, facilities, or equipment used during the Camp. 

I covenant not to file suit against or otherwise sue MSSU. I waive, release, and discharge MSSU and the various schools or facilities that host the Camp, and anyone working on their behalf from any and all liability, claims, actions, demands, expenses, attorney’s fees, breach of contract actions, breach of statutory duty, or other duty of care, warranty, strict liability actions, and causes of action whatsoever, that I might now have or may acquire in the future, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in the Camp. 

I, on behalf of Camper(s), hereby release and forever discharge and agree to indemnify and save and hold harmless MSSU, Camp facility partners, the respective owners (direct and indirect) and each of their respective parents and affiliated and subsidiary companies, volunteers associated or affiliated with the Camp, and each of the aforementioned respective officers, owners, partners, directors, officials, employees and agents, and the other participants in the Camp, of and from any and all injuries (including personal injury, disability, dismemberment, and death), illness losses, damages, claims, liabilities, or expenses of any kind or nature (and whether accruing to me, Camper(s), my heirs, or my personal representatives) that are caused or alleged to be caused in whole or in part by the action, negligence, or failure to act by any Released Party or condition of any real or personal property, facility, or equipment of any Released Party, and that arise out of or are in any way connected with any aspect of the Camp or Camper(s)’s participation therein or attendance thereat. 

PHOTO RELEASE 

I give permission for photographs and videos taken of Camper(s) while participating in the Camp to be used in the promotion and marketing of Camp and MSSU. 

REFUND POLICY 

Changes or Withdrawals made by April 30, 2024, 100% Full Refund 

Changes or Withdrawals made by May 15, 2024, 75% Refund 

Changes or Withdrawals made by May 31, 2024, 50% Refund 

Changes or Withdrawals made by June 15, 2024, 25% Refund 

Should Camper(s) have missing attendance for late arrivals, early departures, vacations, or illnesses, no full or partial full refunds will be issued. 

Should Camper(s) disrupt the camp program, not follow the instructions of camp staff, harm another participant or self, or exhibit signs of illness, I shall promptly retrieve Camper(s) when contacted by MSSU to do so, or, if I am unable to do so, notify MSSU of the person retrieving Camper(s) on my behalf. I acknowledge and agree that no part of the fee paid will be refunded to me should Camper(s) be dismissed from the Camp. I also understand and agree that no reduction or proration of the fee will be made for late arrivals, early departures, vacations or illness. 

CAMP PROGRAM/LOCATION CHANGES 

Programs and locations are subject to change or cancellation due to unforeseen circumstances including, but not limited to, health regulations, safety precautions, low camper enrollment, loss or change of rental lease, etc. In the event of a program or location change, you will be notified so that you can make the appropriate arrangements. In the event that a camp week has two or fewer registrants a week before before the Monday start of the camp, we 1) will cancel that camp, 2) email the parent a week before with suggested options for attending another camp program that includes A) Join us for STEM Camp at ANY TWO of the camp weeks/locations that reached the minimum registration at no additional charge. B) Join us for STEM Camp for the same week but at a different location – if the parent chooses this option we will rebate $100 for that week of camp.

PROGRAM CHANGE POLICY 

We understand that unforeseen circumstances may arise and parents may need to change their child’s enrolled program. To ensure the best possible experience for participants, our program change policy is as follows: 

Requesting a Program Change: Parents may request a program change for their child by submitting an email request to summercamp@maker-state.com at least two weeks before the start of the camp/program. The request must include the child’s name, the camp/program they are currently enrolled in, and the new camp/program you wish to enroll them in. 

Course Availability: All camp/course changes are subject to availability, and we cannot guarantee that the requested camp/course will be available. If the requested camp/course is full, we will work with the parent to find an alternative camp/course that is suitable for their child. Most of the time, there is a space available. 

Additional Fees: If the new program has a higher fee than the original course, the parent will be responsible for paying the difference in cost. If the new program has a lower fee, we will refund the difference in cost to the parent. 

Refunds: If a parent requests a program change and decides to cancel their child’s enrollment altogether, our standard refund policy will apply (see REFUND POLICY above). The parent must submit their cancellation request by email to summercamp@maker-state.com and the refund will be processed based on the date the request is received. 

Late Camp/Course Changes: We understand that unexpected situations can occur, and parents may need to change their child’s program after the two-week deadline. However, any program change requested within two weeks of the start of the program will be subject to a $100 administrative fee. 

By enrolling your child in our program, you agree to abide by this Program Change Policy. We reserve the right to modify this policy at any time, and any changes will be communicated to parents in advance. 

SEVERABILITY OF PROVISION 

If any provision of this waiver document is held unenforceable in a judicial or arbitration proceeding, such provision shall be severed and shall be inoperative, and the remainder of this waiver shall remain operative and binding on the parties. 

CONCLUSION 

I have carefully read the entirety of this liability waiver and release. I agree to all its terms and conditions. I understand that by using maker-state website, I am signaling that I have read, understand, and agree to the terms outlined above.
